Congress legislators call on Governor, allege violation of rules

Dehradun, 5 Feb: On a day of rapid political developments, after tendering their resignations from the membership of the Business Advisory Committee of the Uttarakhand Assembly, Leader of the Opposition Yashpal Arya and senior party leader Pritam Singh, along with other Congress legislators, called on Governor, Lt General Gurmit Singh (Retd) and submitted a memorandum alleging that the government has been openly flouting rules regarding conduct of proceedings in the state assembly.
In the memorandum submitted to the Governor, the Congress legislators said that the government has been openly flouting rules regarding conduct of procedures in the State Assembly. They pointed out that the second session of the year 2023 of Uttarakhand Legislative Assembly, which was adjourned indefinitely at the end of the session on 8 September, 2023, has been reconvened from today. It is clear from the notification of the Legislative Assembly Secretariat (Annexure-1) that this session cannot be considered a special session because the last session had not been prorogued.
Apart from this, by the order of the Secretary, Legislative Assembly, through the Legislative Assembly Secretariat’s letter number 213 dated 25 January, 2024, a letter has also been issued to all the members in which information on urgent public importance such as Rule 53, Information under Sections 58, 299 and Rule 300 has been asked to be taken in the Vidhan Bhawan on every session from 8:30 a.m. to 9:30 a.m. on 6 February 2024.
The Congress legislators claimed that despite all the above mentioned facts, in the meeting of the Business Advisory Committee, postponing Question Hour and urgent public interest notices citing special session is a violation of the operating rules. It is perhaps not appropriate to pass such illegal action on the basis of majority in the Business Advisory Committee. They further claimed that constitutional values are being continuously neglected by the government. Question Hour and information of urgent public importance are being postponed in the name of special session without adjourning the session. The Congress members have sought  the intervention of the Governor to “protect the constitutional values”.
