HC grants relief to Bobby Panwar, others and stays further action against them

Nainital: The Uttarakhand High Court has issued orders to stay further action in a case registered by Bageshwar Police against Uttarakhand Berojgar Sangathan president Bobby Panwar and others including Kartik Upadhyay, Nitin Dutt, Bhupendra Koranga and Ram Kandwal. After hearing the arguments of the petitioners, the state government has been ordered to file its response in this regard.

As per the information made available, a First Information Report (FIR) was registered by the Bageshwar Police Administration on 25 August 2023, for violation of prohibitory orders issued under Section 144 of IPC. Panwar and others were also charged under various other provisions. According to the Bageshwar Police, on 25 August, at 9 pm, Bobby Panwar along with his 10 to 15 companions raised slogans on the way to Mission School. Pamphlets were distributed by them which were appeals containing confusing facts to influence the voting.

In this FIR was registered against Bobby Panwar and 4 other companions under sections 147, 171 (G) 186 and 188 of the Indian Penal Code. Following this, a criminal case was also filed in the court of Chief Judicial Magistrate Bageshwar and a chargesheet has also been filed against all the accused in the case. Challenging the above criminal proceedings, Bobby Panwar, Kartik Upadhyay, Nitin Dutt, Bhupendra Koranga and Ram Kandwal had filed a petition in which the petitioners claimed that they have been falsely accused of baseless accusations by the Police. They claimed that all the allegations against them are baseless and that the administration is trying to suppress the voice of the aware youth who are constantly fighting on the important issues of unemployed youth by intimidating them. The case today was heard by a single bench comprising of Justice Rakesh Thapliyal. Justice Thapliyal in his order stayed the criminal case going on in the Chief Judicial Magistrate Bageshwar till further orders and ordered the state government to file its response. The next hearing on the case will be on 11 November 2024.
