HC stays Govt order on salary re-fixation of LT grade teachers

Dehradun, 21 Jan: The Uttarakhand High Court has stayed the implementation of the government order dated 18 December 2025 regarding the re-fixation of the promotional pay scale for Assistant Teachers (LT Grade) serving in Government Inter Colleges. The Court has directed the State Government to submit its response and fixed 27 April as the next date of hearing in the case.

The matter was taken up before the vacation bench of Justice Alok Mahra today. Petitioners Sevak Singh, Gopal Dutt Pant, Pramod Kumar, Dharam Ram Arya, Pyare Lal Sah and several other lecturers approached the High Court challenging the Government Servant Pay Rules (First Amendment) 2025 and the subsequent order issued by the Finance Secretary on 18 December 2025 regarding the re-determination of promotional pay scales. The petitions contended that under the Government Servant Pay Rules 2016, lecturers and Assistant Teachers (LT Grade) are entitled to one increment when granted the promotional pay scale. However, the State Government has amended those rules through the Government Servant Pay Rules (First Amendment) 2025 and enforced them retrospectively from 1 January 2016.

The petitioners pointed out that the amendment has abolished the single increment that was earlier granted at the time of selection or promotional pay scale. Acting on this, the Finance Secretary issued directions to re-fix the promotional pay scales in line with the revised 2025 rules.

Appearing for the petitioners, Advocate Lalit Samant argued before the Court that the amendment had been applied solely to employees of the educational cadre. He submitted that the State Government could not retrospectively abolish an increment that was legitimately due under the 2016 Pay Rules.

After considering the submissions, the High Court bench stayed the order dated 18 December 2025 relating to the re-fixation of the promotional pay scale for Assistant Teachers (LT Grade). In addition, the court has also sought a detailed reply from the State Government and listed the matter for further proceedings on 27 April.
