Nainital, 24 Sep: The Uttarakhand High Court today heard the bail application filed in the default appeal of Abdul Moeed, son of Abdul Malik of Haldwani, who is the main accused in the Banbhulpura violence case and also of Abdul Malik’s brother, Javed Siddiqui. After hearing the case, the division bench of senior Justice Manoj Kumar Tiwari and Justice Vivek Bharti Sharma have directed the state government to present before the court any objections to the bail applications of Abdul Moeed and Javed Siddiqui. The state government has been given three weeks’ time to file its objections to Abdul Moeed’s default bail and within two weeks on Javed Siddiqui’s default bail. The Court also made it clear that that it is granting the government a last chance.
The next hearing on Moeed’s bail plea will now be held on 26 October, while on Javed Siddiqui’s bail, the next hearing will be held on 13 October. During the hearing, the counsels for the accused argued that the Court has already granted bail to Safia Malik, one of the accused in the case and 50 others in the same case.
The accused’s lawyer argued before the Court that the police have registered a case against them under sections 120B, 417, 420, 467, 468 and 471 of the Indian Penal Code without investigating the case. Months have passed, but the police have not been able to prove their role in the crime. The lawyer also argued that it is necessary for the police to present the investigation report of the crime in the court within 90 days but the Police have not yet submitted the investigation report in this case and under the circumstances, the accused deserve to be released on bail.
