HC issues notice of contempt to IIM Kashipur’s interim chairman

Nainital, 19 Oct: Uttarakhand High Court on Friday issued a contempt notice to IIM Kashipur’s interim chairperson, Sandeep Singh, for not complying with its order dated 1 October. Through this order, dated 1 October, the Court had directed the interim chairman of IIM Kashipur, Sandeep Singh to issue a no-objection certificate (NOC) and vigilance clearance to an employee named Vinay Sharma. A single bench of Justice Alok Verma yesterday, in the Court also issued a notice to the institute’s chief administrative officer (CAO), Ajay Kumar Upadhyay in this respect. The case will now be listed on 12 December as per the direction of Justice Alok Kumar Verma.

Through his petition, the employee, Vinay Sharma, had intimated the Court that he had been served with a show-cause notice after he raised an issue of corruption with Sandeep Singh, the acting chairman of the IIM Kashipur. The notice issued to Sharma had sought an explanation from him as to why disciplinary proceedings should not be initiated over allegations that he obtained confidential information, including the selection committee’s meeting minutes for faculty recruitment, without proper authority or authorisation.  It was also intimated to the court that Sharma had applied for the post of registrar at AIIMS Rajkot and required the NOC for it.

During the previous hearing, the court, after reviewing the charge, commented that the petitioner had indeed been selected for the post at AIIMS Rajkot. During the hearing yesterday, the Court observed that it had already stayed the operation of the IIM order. In view of this fact, the respondents namely the administration of IIM Kashipur cannot withhold the vigilance clearance of the petitioner.

The petitioner is being represented by lawyers Yashvardhan Tiwari, Harsh Vardhan Tiwari and Nisha Bora.  The case will now be listed on 12 December.
