HC permits Cong candidate in Herbertpur to contest municipal poll

Dehradun, 10 Jan: In a significant development, Yamini Rohila, the Congress candidate for the post of president from Herbertpur Nagar Palika, has been granted a major relief by Uttarakhand High Court. The court has granted her permission to contest the upcoming elections, overturning the earlier decision of the returning officer.
It may be recalled that the returning officer in Herbertpur had rejected the nomination of the Congress candidate for the post of Municipal Chairperson, Yamini Rohila deeming the OBC certificate issued to her to be suspicious. This decision had disqualified her from contesting the election, prompting her to seek legal recourse.
However, the single bench of the High Court had also dismissed Rohila’s petition challenging the rejection of her nomination. However, she filed a special appeal, which was heard by a division bench comprising Chief Justice G Narender and Justice Ashish Naithani. After reviewing the case, the bench stayed the single bench’s order and allowed Rohila to participate in the election.
Following the decision of the Double Bench of the High Court, the Congress party has criticised the state government for what it calls an undemocratic attempt to disqualify their candidate. Following the High Court’s order, the party expressed confidence in their victory.
Reacting to the court’s decision, Yamini Rohila expressed gratitude to the public and described the outcome as a triumph of justice over injustice. She also thanked her supporters and reaffirmed her commitment to contesting the election.
Senior Congress leader and former cabinet minister Navprabhat claimed that the petition in the single bench was dismissed summarily without allowing the petitioner’s lawyer to fully present the case. The party then filed a special appeal, and the High Court has granted permission for Yamini Rohila to contest.  Navprabhat added that the written order from the court was expected by the evening and assured that the party would adhere to the directives of the judiciary.
The decision comes in as a major boost to Congress party and sort of a setback to the BJP.
