Quest for Truth behind Kargil Conflict

The 25th anniversary of the Kargil War serves as a reminder of the valour, tenacity, and steadfastness of Indian troops who fought on the icy heights of Dras, Batalik, Mushkoh, and other areas of the battlefield. However, it has also brought back into focus the alleged intelligence and surveillance failures that led to the conflict. Recently, a legal notice served by Major Manish Bhatnagar, formerly of the 5th Battalion of the Parachute Regiment (5 Para), to General VP Malik has sparked renewed debate on these issues.

Maj Manish Bhatnagar has taken umbrage at a recent television interview in which General VP Malik (Retd) claimed that lack of intelligence inputs and surveillance gaps led to the Kargil intrusions. In his legal notice served on 8 July, Maj Bhatnagar contends that it was the disregarded warnings, not a lack of intelligence, that resulted in the intrusions.

The Kargil War and Intelligence Failures

The Kargil War resulted in the loss of 527 brave Indian soldiers, with 1,363 wounded and one taken prisoner of war (POW). The conflict, which took place in the summer of 1999, was marked by fierce battles fought at high altitudes in the difficult terrain of the Kargil district of Jammu and Kashmir. The intrusions by Pakistani soldiers and militants into Indian territory came as a shock to the nation.

In the aftermath, it was revealed that there had been significant lapses in intelligence and surveillance. The National Security Advisor (NSA) admitted to then-Prime Minister Atal Bihari Vajpayee that there had been an intelligence lapse on the part of the security and intelligence agencies of the state. This admission has been a point of contention and debate ever since.

Major Bhatnagar’s Allegations

Maj Bhatnagar’s primary contention is that there were sufficient warnings about the possibility of intrusions, but these were ignored due to complacency or overconfidence on the part of commanders in the chain of command or the intelligence agencies. He argues that the title of General Malik’s book, “Kargil: From Surprise to Victory,” is misleading. According to Maj Bhatnagar, the word “surprise” implies an attack, capture, or approach without warning. However, he insists that there were ample warnings that were neglected, leading to the conflict.

Maj. Bhatnagar was court-martialled in 2001 and dismissed from service for “acts prejudicial to good order and military discipline”. He believes that his dismissal was excessive and disproportionate to the offence and that he was made a scapegoat for the larger failures that led to the Kargil War. His legal notice aims to hold the senior leadership of the Army accountable for their alleged negligence and wilful oversight.

The Legal Notice and its Implications

The legal notice served by Maj Bhatnagar to General Malik seeks the withdrawal of the comments made in the interview. It also aims to bring to light the negligence and dereliction of duty by the senior hierarchy of the concerned formations in Northern Command. By doing so, Maj Bhatnagar hopes to expose the failures that led to the Kargil War and vindicate himself.

The notice’s implications go beyond a simple retraction of comments. It suggests that General Malik and other senior leaders could be called to testify in a civil court. This would mean subjecting them to cross-examination by Maj Bhatnagar’s counsel, a process that could reveal more about the decisions and actions that led to the conflict. Maj Bhatnagar claims to have enough evidence to support his case, which could make for a compelling legal battle.

If the civil suit is filed and admitted for listing, it could lead to a significant examination of the events leading up to the Kargil War.
